NOTICE OF PUBLIC HEARING AND INTENTION TO ADOPT ORDINANCE

NOTICE is hereby given that the Board of Supervisors of Hopewell Township at their regularly scheduled public meeting on Thursday, May 7, 2026, at 7:00 p.m. at the Township Municipal Building at 3336 Bridgeview Road, Stewartstown, Pennsylvania 17363, will hold a public hearing, after which hearing and during which meeting also intends to consider for adoption “AN ORDINANCE AMENDING THE HOPEWELL TOWNSHIP, YORK COUNTY, PENNSYLVANIA, ZONING ORDINANCE TO PROVIDE FOR THE REGULATION OF DATA CENTERS”; Section 1 of the Ordinance adds a definition for “COMMUNITY NOISE EQUIVALENT LEVEL (CNEL)”; Section 2 of the Ordinance adds a definition for “DATA CENTER”; Section 3 of the Ordinance adds a definition for “DATA CENTER ACCESSORY USES”; Section 4 of the Ordinance adds a definition for “DATA CENTER EQUIPMENT”; Section 5 of the Ordinance adds a definition for “FOOTCANDLE”; Section 6 of the Ordinance adds a definition for “SENSITIVE RECEPTORS”; Section 7 of the Ordinance adds a definition for “WAREHOUSE”; Section 8 of the Ordinance adds Data Centers as a use by Special Exception in the Commercial Zone; Section 9 of the Ordinance adds Data Centers as a use by Special Exception in the Industrial Zone; Section 10 of the Ordinance adds specific requirements for Data Centers relating to location/setbacks, sensitive receptors, noise, substations, utility connections, aesthetic standards, lighting, fire safety, performance standards, water feasibility, emergency response, environmental impact, threatened and endangered species, green building techniques, LEED certification, solar energy compatibility, cooling, and decommissioning; Section 11 provides a repealer; Section 12 adds severability provisions; Section 13 makes the ordinance effective immediately after its approval as provided by law.
